These General Terms and Conditions, short AGB, of The PatchFactory, Holmfors 4, 914 94 Nyåker, Sweden ( owner: Andree Mike Koriath ), are valid for and about all contracts made on this platform ( internet shop: https://www.patch-factory.eu ). Herewith we expressly exclude the conditions of the seller, unless these are approved separately and in written form and recorded in advance and signed by both parties.

Consumers and or buyers, in the sense of these AGB, are each natural person, who is before the law fully business-capable. Legal persons in the sense of associations or companies always have a natural contact person.

All offered articles in the online shop ( https//www.patch-factory.eu ) are in principle property of called The PatchFactory ( owner: Andree Mike Koriath ). This is valid in particular for motives, as well as motives in word and picture and motives consisting only of Word. All our motives, as well as motives in Word and picture as well as motives consisting only of Word, possess a time stamp in the manufacturer/raw file, so that exactly can be determined, when this motive was provided.

In case of fabrications especially on customer's request, the right of use falls on the customer, but the product itself remains the property of The PatchFactory.

 

Manufacture of trademark articles or trademark products will be strictly refused until the submission of a certified release, for processing the motif. This must be presented to us by the client and must be issued by the trademark owner. We reserve the right to check this release and to refuse the order in case of ambiguities.

The PatchFactory assumes no liability and / or responsibility, should our motifs, as mentioned above in word and picture or combined, or as custom-made, be misappropriated and this can then lead to confusion and or equal treatment of well-known brands.

The customer can put together all articles individually in the online shop and order any number of items in the colours offered and in the quantity of his choice. Some articles can be further or extra individualized, for this they are requested in the appropriate article to make further details.

All articles which can be ordered at The PatchFactory Online Shop ( https://www.patch-factoy.eu ) are manufactured after successfully completed order process by us individually in color and if necessary further individualizable information by the customer.

For customers, guest accounts or visitors of the online shop the prices are displayed incl. the legal value added tax.

With a dealer account, which is provided by us with separate conditions, the prices are indicated in net.

The VAT will be shown separately in the invoice.

 

4)

The customer / buyer can personalize any item. On the one hand, this can be provided with further information, such as names or numbers, for certain articles. In the case of articles where the indication of a personalization data is given, e.g. desired name / desired word the article is manufactured according to the data in the article.

In the case of special productions, which e.g. enlargements or reductions of one of our articles are desired, the customer must contact us in advance. This cannot be adapted after the order process.

Special productions, which are manufactured after customer's request, like Logo production or similar, we will discuss in writing and by telephone. The pricing depends on the expenditure and material consumption.

The online shop automatically sends the customer an order confirmation after a successful order process. If you have not received this confirmation, please check the spam folder first. Also the dispatch / receipt of a mail can take some hours under circumstances (24 hours are indicated by some providers as a guideline). We therefore ask you to wait for this time as long as possible or to contact us separately before completing a new order process.

After completion of the order process by the customer, it comes to a legally valid sales contract. This cannot be revoked by the buyer due to the individualization

You can pay in our online shop with prepayment, PayPal or credit card.

With prepayment you get the account information after the order process via mail. These include IBAN and BIC numbers, bank name and bank location. Please transfer the invoice amount in the currency in which you ordered. Possible transfer costs are not entitled to deduct from the purchase price. Within the EU, or in European member countries with SEPA, there are no extra transfer costs. Depending on bank and country a transfer can take up to 5 working days.

PayPal is a payment service provider. Please refer to https://www.paypal.com for the terms of use. For customers with a PayPal account the terms of use are deposited in the respective customer account. In order to process payments with PayPal or via PayPal, you do not necessarily have to have a PayPal account, you can find more information about PayPal ( https://www.paypal.com ).

Credit card will be billed by the payment processor Wirecard. The terms of use for this are deposited with Wirecard Payment Solutions ( https://www.wirecard.com ).

The dispatch takes place via letter dispatch by the Swedish PostNord. Information and conditions can be found at https://www.postnord.se . Each letter has a Shippment-ID, which can clearly prove that the shipment has been sent to the delivery address. Delivery will be made exclusively to the delivery address provided by the buyer.

Our stated delivery times refer to production times and delivery times.

If the shipping company returns the goods to The PatchFactory because the shipment was not deliverable, the customer will be responsible for shipping costs, as well as other shipping costs after confirmation by the customer that the delivery address is correct.

 

 

8)

The customer is obliged to check the goods immediately after receipt for possible errors or defects.

Reasons for complaint are not, stripes on the product, or if necessary bends in the carrier foil.

We ask you to send us a picture of the goods to be complained about, if possible also detailed photos. Do not return the ordered goods without contacting us in advance.

Vouchers or discount coupons can be entered independently during the checkout process. Subsequent entry by The PatchFactory is not possible.

The PatchFactory does not sell vouchers. A voucher is issued by The PatchFactory and sent directly to the customer.

The voucher is entered exclusively by the customer. In case of loss the customer is liable.

 

10)

Trader accounts are set up manually by us. The contests at merchant account are excl. VAT.

A calculation of the VAT is dependent on the USt-IdNr.

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for out-of-court settlement of disputes arising from online sales or service contracts in which a consumer is involved.

The PatchFactory is not obligated or prepared to participate in any dispute resolution procedure before a consumer arbitration body.
