1)

These general terms and conditions, in short GTC, of The PatchFactory, Holmfors 4, 914 94 Nyåker, Sweden ( Owner: Andree Mike Koriath ), are valid for and about all contracts that are made on this platform ( Internetshop: https://www.patch-factory.eu ) are transacted on this platform. Herewith we explicitly exclude the seller's conditions, unless they are approved separately and in writing and recorded in advance and signed by both parties.

The PatchFactory sells the articles offered in the online shop (https://patch-factory.eu ), also under the name/pseudonym "DerAufbügler" (www.deraufbuegler.eu). This name is used exclusively to offer the articles in the German-speaking area on the Etsy sales platform. The name / pseudonym is merely a more understandable translation of the product in the name.

Consumer and/or buyer, in the sense of these terms and conditions, is any natural person who is fully capable of conducting business before the law. Legal entities in the sense of associations or companies always have a natural contact person.

All offered articles in the online shop (https//www.patch-factory.eu) are basically property of named The PatchFactory (owner: Andree Mike Koriath). This applies in particular to motives, as well as motives in word and picture and motives consisting only of Word. All our motifs, as well as motifs in word and picture and motifs consisting only of Word, have a time stamp in the manufacturer / raw file, so that it can be determined exactly when this motif was created.

In the case of custom-made products, the right of use falls to the client, but the product itself remains the property of The PatchFactory.

Fabrications of branded articles or branded products, will be strictly rejected until a certified release for the processing of the motif is submitted. This is to be submitted to us by the client and must be issued by the trademark owner. We reserve the right to check this release and to reject the order if necessary in case of ambiguity.

The PatchFactory assumes no liability and / or responsibility if our motifs, above mentioned in word and image combined, or as a custom-made product, are used for other purposes and this then leads to confusion and / or equalization of well-known brands.

The customer can put together all articles in the online shop individually and order them in the colours offered and in the quantity of his choice. Some articles can be further or extra individualised, for this purpose you will be asked to provide further information in the corresponding article.

All articles that are available at The PatchFactory Online Shop ( https://patch-factoy.eu ) can be ordered after successful completion of the ordering process and are manufactured by us individually in colour and, if necessary, further individualisable details by the customer.

For customers, guest accounts or visitors of the online shop (except Etsyshop) the prices are displayed including the legal value added tax.

In the case of a dealer account, which is provided by us with separate conditions, the prices are shown in net.

The value added tax is shown separately in the invoice only for the online shop ( https://patch-factory.eu ). The distribution via the online platform Etsy is tax-free. The buyer is responsible for paying any taxes.

The customer / buyer can personalize each item. On the one hand, this can be done for certain articles, with additional information, such as names or numbers. With articles, where the indication of a personalization data is given, e.g. desired name / desired word, the article is manufactured according to the data in the article.

In the case of custom-made products, e.g. enlargements or reductions of one of our articles, the customer must contact us in advance. This cannot be adjusted after the ordering process.

We will discuss custom-made products, which are manufactured according to customer requirements, such as logo creation or similar, in writing and by telephone. The pricing is based on the effort and material consumption.

The online shop automatically sends the customer an order confirmation after a successful order process. We ask you, should you not have received this, to look in the Spam folder. Also the dispatch/receipt of an e-mail may take a few hours (24 hours are given as a guideline by some providers). We therefore ask you to wait for this time as long as possible or to contact us separately before you complete a new order process.

After completion of the ordering process by the customer, it comes to a legally valid sales contract. This cannot be revoked by the buyer due to the individualization process.

You can pay in our online shop with advance payment, PayPal or credit cards, Giropay, iDEAL, Sofort and Bancontact.

If you pay in advance, you will receive the account information after the order process via mail. This includes IBAN and BIC numbers, bank name and bank location. Please transfer the invoice amount in the currency in which you have ordered. You are not entitled to deduct possible transfer costs from the purchase price. Within the EU, or in European member countries with SEPA, there are no extra transfer costs. Depending on bank and country, a transfer can take up to 5 working days.

PayPal is a payment service provider. For the terms of use, please visit https://www.paypal.com. For customers with a PayPal account the terms of use are stored in the respective customer account. In order to pay with PayPal or via PayPal you do not necessarily have to have a PayPal account, you can find more information about PayPal ( https://www.paypal.com ).

Credit cards, Giropay, iDEAL, Sofort and Bancontact are settled via the payment processor Stripe. The terms of use are available at Stripe ( https://www.stripe.com ) is deposited. The offered payment options are dependent on the country from which the order is placed.

7)

The dispatch takes place via letter dispatch by the Swedish PostNord. Information and conditions are available at https://www.postnord.se ...to be removed. Each letter item has a Shippment ID, which can clearly prove that it was sent to the delivery address. The delivery will only be sent to the delivery address provided by the buyer.

Our indicated shipping times refer to production times and delivery times by PostNord.

If the shipping company returns the goods to The PatchFactory because the shipment could not be delivered, the customer is responsible for shipping costs, as well as other shipping costs after confirmation by the customer that the given delivery address is correct.

8)

The customer is obliged to check the goods for possible errors or defects immediately after receipt.

Reasons for complaint are not, strips on the goods, or if necessary kinks in the carrier foil.

We ask you to send us a picture of the goods to be claimed, if possible also detailed photographs. Do not return the ordered goods without contacting us in advance.

9)

Vouchers or discount coupons can be entered independently in the checkout process. Subsequent input by The PatchFactory is not possible.

The PatchFactory does not sell vouchers. A voucher will be issued by The PatchFactory and sent directly to the customer.

The voucher is entered exclusively by the customer. The customer is liable for loss.

10)

Merchant accounts are set up manually by us. The contests for merchant accounts are exclusive of VAT.

A calculation of the VAT is dependent on VAT-IdNr.

Dealer accounts and commercial customers will receive separate terms and conditions from us, which will be clarified individually and personally with the respective persons and set down in writing.

The EU Commission provides a platform for online dispute resolution on the Internet under the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.

The PatchFactory is not committed nor ready for participation in dispute resolution proceedings before a consumer arbitration board.
